The Bundestag is requested to adopt the following recommendation:

The Act to Reform the Weapons Law adopted by the German Bundestag at its 234th sitting on 26 April 2002 has been amended in accordance with the decisions annexed hereto.

In keeping with Rule 10, paragraph (3), first sentence of its Rules of Procedure, the Mediation Committee has decided that the German Bundestag should vote on the amendments as a whole.

Annex

Act to Reform the Weapons Law

The Overview of contents

In the Overview of contents, following the words "Article 17 Return to Uniform Order of Ordinance", the words "Article 17a Amendment of the Act on the Federal Central Criminal Register" shall be introduced.

Article 1 (Amendment of the Weapons Act)

Article 1 shall be amended as follows:

1. In the Overview of contents of § 27, the words "training in defensive shooting" shall be deleted.
2. § 6 shall be amended as follows:
a) The following sentence shall be added to subparagraph 1:
"Personal suitability may also be precluded by a decision entered in the Juvenile Delinquency Register or orders under § 60, subparagraph 1, numbers 1 to 7 of the Act on the Federal Central Criminal Register."
b) In subparagraph 2, following the words "the appropriate authority", the words "may require" shall be replaced by the words "shall require".
c) The following subparagraphs 3 and 4 shall be added after subparagraph 2:

"(3) In order to receive an authorization for the acquisition and possession of a firearm for the first time, persons who have not reached the age of twenty five years shall submit a certificate from a medical health officer, consultant or psychologist relating to their psychological suitability, at their own cost. The first sentence shall not apply to the acquisition and possession of firearms pursuant to §14, subparagraph 1, second sentence.

(4) The Federal Ministry of the Interior shall be authorized to issue, through an ordinance and with the consent of the Bundesrat, provisions on the procedure to be followed by the appropriate authorities regarding the production, submission and recognition of the certificates referred to in subparagraphs 2 and 3."
