Payments granted in advance are the advance payments made in 2000 and (apart from for the REP and STATT parties) the final payments made on the basis of the provisional calculation dated 1 December 2000. In cases where overpayments were to be repaid in the form of a negative final payment, the repayments have already been made, apart from for BFB, cf. note 4.
The amount shown in the "Final calculation" column is reduced by the entitlements adjudged to be lost in accordance with Article 23 a Para. 1, first sentence of the Law on Political Parties in the total amount of DM 6,588,213.00 to DM 60,146,120.97 as calculated in the course of the provisional allocation carried out on 1 December 2000. The funds that have not been disbursed as a consequence of this decision remain in the federal budget as underspend. The party has challenged a further loss of entitlement in the amount of DM 1.2 million (VG Berlin 2 A 137.00). In view of the postponing effect of the legal action, the loss of entitlement is suspended so that the amount withheld as at 1 December 2000 was provisionally disbursed as at 15 February 2001. The amount of DM 16,864,786.52 shown in column 6 is thus increased to DM 18,064,786.52.
Shown for information purposes only. The party was dissolved on 31 December 2000 and is therefore, according to Article 18 Para. 8 of the Law on Political Parties, no longer entitled to public funding from this time onwards. This does not affect the funds granted to it in 2000 on the basis of the provisional allocation dated 1 December 2000. The provisional payments granted in advance (cf. column 3) originally amounted to DM 650,598.45. This amount has been reduced to DM 431,003.80 through set-off of the final payment claim of the Hamburg regional association against the Land Hamburg in the amount of DM 2,728.50 and through repayment of the 3rd advance payment secured through bank guarantee in the amount of DM 216,866.15. The remaining unrecoverable claim in the amount of DM 105,514.81 will come from the federal budget. However, this does not result in the absolute limit being exceeded, since in the case of the Tierschutzpartei (Animal Protection Party) the funding must be reduced by DM 112,564.99 in order to comply with the relative limit and this sum remains in the federal budget as underspend.
